• We do not complete, prepare, or submit any government applications or forms on your behalf.
• We do not enroll you in any government program.
• We do not communicate with any government agency on your behalf.
• We do not guarantee any specific outcome, eligibility determination, or benefit amount.

3.2 Disclaimer of Accuracy

Screening results are estimates only and are subject to change based on program eligibility rules, income thresholds, household composition requirements, geographic restrictions, program availability, and other factors that may not be fully captured by our screening tool. Eligibility rules for government programs change frequently, and our tool may not reflect the most current program requirements at all times.

4. Payment Terms

4.1 Service Fee

The service fee for Benefits Confidence is the amount displayed to you on the website at the time of purchase (the "Service Fee"). This fee is for the delivery of your personalized benefits screening report and access to the Benefits Confidence platform. The Service Fee is disclosed to you prior to your payment authorization.

4.2 Payment Prerequisite

The Benefits Confidence screening report will not be activated, delivered, or made accessible until your Service Fee has been successfully processed and funds received. Submission of your information does not constitute activation of your report.

4.3 No Refund Policy

Due to the nature of the service (immediate delivery of a personalized digital report upon access code redemption), all fees are non-refundable once your access code has been issued or your report has been made available, except as required by applicable law.

5. Access Code and Report Delivery

Upon confirmation of payment:

• You will receive an email at the address you provided containing your unique, personal access code and a link to BenefitsConfidence.com.
• Your access code is for your personal use only and is non-transferable.
• We are not responsible for delays caused by incorrect email addresses, spam filters, or other factors outside our control.
• Access codes expire 90 days from the date of issuance.

6. Privacy and Data

6.1 Information Collected

Benefits Confidence collects your name and email address at the time of purchase. Through the screening questionnaire on our website, you may also voluntarily input household size, income, geographic location, and current program participation information for screening purposes.

BENEFITS CONFIDENCE DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT; OR (C) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of and access to the Services.
• Your violation of any provision of these Terms.
• Any information you submit to our platform, including any inaccurate, false, or misleading information.
• Your violation of any third-party right, including any privacy, intellectual property, or government program requirement.
• Any claim that your use of the Services caused damage to a third party.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter informally by contacting Benefits Confidence at the contact information provided on our website. We will make good-faith efforts to resolve disputes within 30 days.

12.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute shall be resolved by binding arbitration administered under the rules of the American Arbitration Association ("AAA"), except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction for matters involving intellectual property or unauthorized use of the Services. The arbitration shall be conducted in Colorado, or by telephone or video conference.

12.3 Class Action Waiver

YOU AND BENEFITS CONFIDENCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this class action waiver is found unenforceable, then the arbitration provision shall be null and void.

12.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado and applicable federal law, without regard to conflict of law principles.

13. Modifications to Terms

Benefits Confidence reserves the right to modify these Terms at any time. 14. Termination

Upon termination, your license to use the Services shall immediately cease. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 9, 12, and 14) shall survive.
